US–CHINA TRADE

The Glossary

Tariff Exclusions

Product-specific carve-outs from Section 301 lists — granted, expired, and politically loaded.

Definition

USTR processes let importers petition for exclusion of specific products from 301 lists where no non-Chinese alternative exists. Thousands of exclusions were granted in 2019-2020, expired piecemeal, were partially reinstated in late 2021, and reopened with the four-year review in 2024. The April 2025 electronics carve-out from reciprocal tariffs was the largest single exclusion of the era — sparing roughly a quarter of bilateral trade from the peak.

Why it matters

Exclusions are the quiet subsidy program inside the tariff war: lobbying power maps closely to which products escaped, and their churn makes "the" tariff rate a range rather than a number.
